This Terms & Conditions is also called Terms of Service or Terms of Use or User Agreement between Customer / User and BINGRM2 LLC and HOBEY.net

This User agreement is effective for all Users and up-to-date as of July 1, 2022

This User agreement is a contract between You and BINGRM2 LLC and its subsidiary, Hobey.net (“Us”, “We”, “Our”, “Ours”, “Site”, “Platform”), governing You as customer (“You”, “Your”, “Yours”, “User”) visiting Our website, purchasing related products, services, booking or making reservations of Our travel/tours/vacations (“Travel Experience”),  use any of Our services through Your  Hobey.net account. You must be at least 18 years old, or the age of majority in Your state of residence to book and set an account with us. If You are interested in Our kids programs and under 18 years old, You must have Your   parents or guardians to sign up and book for you.

By opening and using Hobey.net account and use Our services, You agree to comply with all of the terms and condition of this User agreement, including privacy policy, refund and cancellation policy, fees pages, and any upcoming changes in the policy updates page at the time You accept this User agreement.

Please read carefully all of the terms and conditions of this User agreement, the terms of the above policies. We may revise this agreement and the terms and conditions and policies mentioned above and post as updated version and mark effective date of newer version.  By using and continuing to use Our services, You agree to abide and be bound by those terms, conditions, policies and changes, updates to them. If You do not agree to the Terms and Conditions, please do not use Our website, Our services, do not book and make reservations, or call Our customer service center, You may close Your   account if you’ve already have one.

Our Platform and Our Values: 

By using this Site (Platform), You as customer agree that You abide by Our values and terms of use.

We strive for the best services for Our customers and ensure their satisfaction, and take reasonable best care in providing Our Platform. We can’t guarantee that everything is accurate, and offerings in Our website can be tentative and changed at time of service due to any unforeseeable natural, social, government, diseases, and pandemic, change of events, external to the parties, personal actions, and information accuracy from providers.  When You book a travel/vacation/tour with us, We are responsible for the Platform. We work with companies that provide local support services. They are separate entities and can’t represent Us nor have controls over Our Site/Platform. Our platform is not an endorsement and do not take any legal responsibilities of any Service Provider and its products, services, vehicles, vessels, and facilities, etc.

When You use Our Site to book or purchase, You need to make sure all your information, including names, addresses, phones, emails, payment, and other details required by the Site is accurate (in English and in languages of Your residence to ensure delivery) and up to date, otherwise You might not be able to access services or receive the products. You are responsible for anything that happens with Your Account, and don’t share Your User name, password and keep them in a safe secure place and change password periodically.  Some of Our Programs/Services in high demand with limited seats, and certain giveaways and awards are based on seniority. So it’s Your responsibility to keep Your account active and accurate in order to receive those priorities.  We count the highest number of consecutive years if You have closed periods in between.

Responsibility and Limitation of Liability

We are committed to work Our best to ensure customer satisfaction. Please read this carefully. If You have any question, problem, issue, claim or dispute in any way with any of Our service, product, policy, service agent, representation, and presence (each a “Claim”, “Dispute”, or collectively, “Claims”, “Disputes”), You are mandated to follow the procedures We set forth.  You agree to give Us an opportunity to resolve it by providing notice or sending email (a written “Notice of Dispute”) with detailed information regarding the nature of the Claim to the Customer Service to resolve it. If We are unable to resolve Your Dispute within 90 days of receipt, You may pursue arbitration or small claims court. You, the customer or third parties and BINGRM2 LLC and HOBEY.net agree that any Claim shall be resolved by final and binding arbitration administrated by American Arbitration Association, under no circumstances nay claim be brought or arbitrated as a class action or proceed on a purported representative capacity. This Agreement is governed by the laws of the State of Rhode Island, United States of America.  As an exception to arbitration, BINGRM2 LLC and HOBEY.net and you, third parties agree that any disputes or claims not subject to arbitration, We and You have the right to pursue in a small claim courts, and shall be resolved exclusively in the federal or state or local courts of Rhode Island.  You consent and agree to personal jurisdiction in those courts that any such claim shall be resolved individually without resort to any form of class action.

By applicable law, under no circumstances shall we, which including Our suppliers, distributors, subsidiaries respective officers, directors, consultants, employees, representatives, licensors, agents, or others involved in creating, sponsoring, promoting, marketing, making the Site (“the Parties”) and its contents, be liable for i) personal, individual or entity for any direct or indirect loss or damage; ii) loss of business opportunities, revenues, profits, use, data or goodwill; iii)inability to use, unauthorized use of performance or non-performance of the Platform; iv) inaccurate information, error or outdated information at any part of Our Site; v)any errors or inaccuracies information, software, products, services , graphics contained or obtained through the Site; vi)unforeseeable majeure or any social, economic, governmental, personal events or situations that beyond Our control; vii)the contagious nature of COVID-19 or similar pandemic disease You exposed to or infected by through participating in Our tours/vacation/experiences/events/activities. The cost of Your booking or purchasing, shown in the confirmation email, is the most We will be liable for. The liability limitations shall apply regardless of the forms of actions, whether it is contract, tort, negligence, strict liability or any others.

Unless We clearly stated, the travel services or Our programs or Our service providers are independent contractors and not agents or employees of the Parties. We make no representations, warranties or commitments related to their products or services. To the extent permitted by law, We and the Party do not assume liability or for any accident, injury, damage, loss, death, delays due to any reason. If You are in breach of these terms or service providers’ terms We will not be liable for any loss or cost You incur and You won’t be entitled to any refund.

Indemnification, Ethics and Behavior

You agree to shield and indemnify Us and the Parties from and against any claims, causes of action, losses, damages, fines, penalties fines, or other costs or expenses of any kind. You agree You use the website as it intended for improving, sharing, traveling, and such healthy lifestyles. We have the right to stop You from making any booking or purchases or cancel any bookings you’ve made, or stop You from using Our Site or Platform if i) You are not compliant with Our values or applicable laws and regulations; ii) fraud or abuse; iii) unlawful, unethical, or inappropriate behaviors in relation to Us or any entity We work with, such as violence, threats, invasion of privacy, etc. iv) violation of this agreement.  If We cancel Your booking or purchase for these reasons, You won’t be entitled for a refund. If You believe We cancel incorrectly, please contact Our Customer Service for further actions.

We reserve the right to edit or change submitted contents, such as listings, contents, reviews, blogs and or any media contents from third parties. If You submit contents to Our website, You represent and responsible for that listing. You agree to indemnify and hold BINGRM2 LLC and Hobey.net harmless for any and all claims relating to those contents of published listings.

Copyright, Trademark, Media Gallery, Website Contents

The website and all of its contents, including trademarks, images and videos in the media gallery, articles, posts, and blogs etc. are property of BINGRM2 and HOBEY.net and protected by the United States and international laws, including copyright and trademark laws. They cannot be reproduced or copied without permission. You can use the contents and images only if You have the written permission from Us or contract with us, with clearly stated intended purposes of use, dates and duration of use. You shall comply with the terms in such written permit or contract. You shall comply with all applicable laws in the country in which You operate when using this site, the contents and the images. If the contract periods end or permission revoked or discontinued for any reason, You agree to immediately stop using the contents of the site and delete and destroy all copies of contents, including images. All images provided by Hobey.net are either original photography or copyrighted and are owned by us. All rights are protected by the United States and international copyright laws.

You are solely responsible for determining whether You use of any content and image needs additional consent or requirements from third parties. If You are not certain about Your rights to use any content or image on Our site, You are responsible for consulting with legal advisors. We respect the intellectual property rights of others and if You believe in good faith that a file or image on Our site that represents such an infringement, You agree to immediately notify Us by written notice under the Digital Millennium Copyright Act, with all required information by the Act. You agree to give Us 60 days to take appropriate measures and resolve. The notification can be sent to Hobey.net by email to: legal@hobey.net . We will not process Your notice if it’s incomplete. We reserve the right to change or remove contents on the Site alleged to be infringing at Our sole discretion. You could be held liable for alleging false claims of copyright infringement.

Booking, Making Reservation and Payment

Your booking, making reservation or accessing contents of the Site means You agree to the terms and conditions of use. You must be 18 years of age or lawful age by Your country or state of residence. You may only use this Site to make legitimate reservations/booking/purchasing/services offered. You agree to provide Your legal name same as in Your passport and true/correct contact information related to Your use of the Site. By using credit card or any other payment methods, You warrant that You have the authority to use the credit card and have enough funds to fulfill the reservation/booking/purchasing. It is a violation of law to place a reservation/booking/purchasing in a false name or with an invalid method of payment. We reserve the right to cancel any reservation/booking/purchasing or any other transactions that it reasonably believes to have been fraudulently made. You are held liable for making false or fraudulent reservation/booking/purchasing or any unreasonable, illegal actions that impose harm to the operations of the Site.

When You make a reservation, You agree to pay the cost of the Travel Experience, including any taxes and charges that may apply. If You have any questions about the charges, it’s Your responsibility to make sure all those items charged are suitable for Your Travel Experiences before booking or purchasing. It’s Your responsibility to find out details of mandatory extra items (such as federal and state taxes, and fees) and optional extra items You may choose from. It’s solely Your responsibility to decide if the optional items’ contents and terms and conditions are appropriate for Your selected Travel Experience. It’s possible that the system and the site glitch cause obvious errors or imprints, those are not binding. For example eight days travel was mistakenly written as $100. We may simple cancel and let You rebook or refund Your money you’ve paid. Any discount or coupon will be applied at check out. Some discount and coupons have expiration date, or not from authoritative sources, may not be applied.

By using Our platform or site to make a reservation, You accept and agree to the Terms and Conditions, and Cancellation and Refund Policy. For some products and services, We either require upfront payment and/or payment during travel. Please read the details and contents carefully because each of them may have specifics details related to that travel products. If You have any questions, please send an email to hello@hobey.net or call Us with details of: name of the package, dates, prices, how many people traveling, and other information needed.

If You have a question about a charge on Your credit card from Your credit card statement relating to your reservation from Us, You agree to contact Us by email hello@hobey.net or call Us with reservation confirmation number and other details. You agree that you give us 30 days to resolve the issues related to the charge prior to dispute any chargeback. We reserve the rights to rebut any chargebacks We believe is not accurate or improper and shall recover the costs of such chargeback claims from You, such as non-cancellable reservations; charges authorized by others that have direct access to Your credit card; from providers that consistent with product description; chargebacks rising from force majeure or other uncontrollable circumstances beyond Us.

The Travel Experiences and the membership fees and are different from one another based on levels and categories. We encourage You to consult with or request more information from Your director or counselor if You have further questions beyond the contents on the Site. We encourage You to read FAQ that provide some useful information for your Travel Experience.

Our Travel Experiences may include air, land and or water transportation. Our tours specified as Air and Land include in its tour price round-trip economy air from designated gateway cities as shown, and contracts with those airlines the company to provide the level of service, routings, and value necessary for Your entire trip. While another airline may offer a more direct connection, it may be at a price unavailable at the lower group rates. You will receive Your preliminary air schedule approximately 2½ months prior to departure. Please note that seat assignment on Your international flight is usually done at airport check-in. We are unable to guarantee any seat assignments. Due to the nature of tour operator tickets, other restrictions apply, including, but not limited to, frequent flyer mileage accrual, stopovers, alternate travel dates, upgrades, and airline taxes and fees. If You prefer to make Your own travel arrangements, Land only is available on most tours. Since international and domestic air schedules are subject to change at any time, We recommend that if You choose to make Your own airline reservations, You do not purchase non-refundable tickets or those with high penalties for changes. If You choose to make Your own air arrangements, We shall not have any liability for any loss resulting from cancellation of this tour or changes in this tour.

If the package is land only, the price not Included in the Package Price: Airfare when purchasing a Land Only package; costs of passports and visas; immunizations, inoculations, and COVID-19 testing; personal expenses such as beverages, laundry, room service, and meals not specified; airport transfers when purchasing a Land Only package; communication charges; gratuities to Your Tour Director, which are at Your discretion (suggested gratuities: $10-$15 per traveler, per day); optional sightseeing; and travel protection insurance. Additional baggage fees may apply and are subject to change at any time. You should confirm directly with Your airline(s) prior to departure.

Cancellations Policy

If You must cancel Your Travel Experience or Vacation Packages, the effective date of cancellation will be upon Our receipt of Your written notification.

Travel insurance is strongly recommended in the event of cancelling or changing. For your convenience, here are some reputable travel insurance companies:

Long before the scheduled departure date, we make reservations to ensure your travel experience and the spot. There are fees incurring because of those reservations. If you don’t have insurance, we have to charge cancellation fee according to the schedule below to recover some of those losses.

We strongly suggest you to purchase insurance and protection plan to protect your travel investment at time of booking.

Upon reservation, You must provide Your full legal name as it appears on Your passport, as well as Your date of birth and gender. In the event an airline ticket is issued with incorrect information You have provided, You will be responsible for charges associated with the ticket’s reissue.

If you want to make changes to your booking, there are several factors associated with your changes and fees. Example factors that affect your changes:

  1. how close to travel date, refer to our terms and condition
  2. availability
  3. what program you are about to change
  4. fees related to changes

Disclaimer of Warranties

The information, materials and contents provided by or through the Site to You “as is”, We make no warranties or representations of any kind, as to the operation of the Site. To the fullest extent permissible, We disclaim all representations, warranties and implied warranties of merchantability or standards of efforts to Your acceptance level of quality or fit Your or We defined purposes. We disclaim all representations or warranties that this Site will operate error-free without defects, uninterrupted, virus free of any system, materials, efforts, informational contents or non-infringement of the rights of third parties. We disclaim any warranties regarding timelessness, accuracy, completeness, suitability, availability, reliability of any contents of any kind within the Site for any purpose.

The liability of Us, or sponsor, or third parties, or other providers that related to Us is strictly limited and have their own terms. We may purchases transportation, hotel accommodations, and restaurant and other services from independent suppliers not under Our control. When We serve only as agents for these suppliers in securing tour arrangements, and We will not accept responsibility for wrongful, negligent, or arbitrary acts or omissions of these independent contractors, or of their employees, agents, servants, or representatives. We and Our affiliates are not liable for injury, damage, loss, accident, or delay that may be caused by events not within Our control, including, without limitation, acts of terrorism, war, strikes, the defect of any vehicle, or the negligence or default of any third party. All coupons, receipts, and tickets issued are subject to the terms and conditions specified by the air carriers, cruise lines, and other independent suppliers. We will make every effort to operate Our tours as planned, but We reserve the right to make itinerary changes as necessary. If unforeseen circumstances require Us to change a hotel, We will select alternative accommodations of the same or better quality.

Health and Medical Issues

There are reasonable amount of physical movements in the whole Travel Experience so We request that You be in good health to participate in Our Travel Experience. There is a reasonable amount of walking, and You must be able to get on and off motor coaches and boats on Your own. We regret that We cannot offer individual assistance; in such cases You must be accompanied by a companion who will assist You. Please note that many of Our tour itineraries, for reasons beyond Our control, do not accommodate wheelchairs. Please call or e-mail Us to hello@hobey.net to inquire and We will do Our best to answer any questions You may have. We encourage you to purchase travel and health insurance for your travel. We reserve the right to remove anyone whose physical or mental condition, in Our sole discretion, compromises the operation of the Travel Experience or detracts from the enjoyment or safety of the other passengers. In that event, We and our affiliates assume no financial responsibility for any unused portion of the tour.

While Our Party / Parties are pleased to facilitate travel opportunities for You with tour operators that specialize in high-quality educational travel, please be aware that Our Party does not conduct, manage or operate these travel experiences, or act as an agent for travelers interested in tours. Tour operators and travelers are responsible for making their own safety decisions concerning this travel and, as a facilitator between travelers and the tour operators with whom travelers make arrangements for completing travel, Cornell’s role and liability are strictly limited. Specific tour operator and national health and safety protocols will apply to each trip, and travelers should review all protocols and trip terms and conditions, including terms and conditions regarding cancellations, refunds, health and safety, and insurance prior to making a reservation. Cornell is not responsible for changes to trips or travel arrangements or for losses, expenses, damages, or injuries resulting from travel.

Other Miscellaneous Items: If not mentioned in the above sections, if you participating HOBEY programs, you agree that,

  • The pick up location is specified in the program but will be confirmed the days before scheduled start date; You have to be in the location 1 hour before the scheduled pickup time. We are not responsible for any late or miss of flight or ground transpiration.
  • There are land only, and land & air programs. We could help you to book airfare if you make request. For land only program, we are not responsible for flight delay or missed scheduled start date of your travel.
  • Schedule & events in the program descriptions are tentative. It could be different based on weather. local offerings, and other uncontrollable conditions. But we will make sure to communicate with you.
  • Accommodations and meal locations and facilities may change based on availability. During campaign or special offering we will do our best to ensure the same level of accommodation but not guaranteed.  Taxes, fees, gratuities or meals will be charged for guests in “free guests” programs.
  • Special handling fee and non-refundable deposit is incurred while we make reservations are nonrefundable. Refer to Cancellation Policy.
  • Some programs are free for kids 6 and under. Some free for kids 12 and under. Usually kids 6 to 17 have reduced rate based on specific program descriptions.
  • Abide by the rules and respect our values. Be courteous to other travel companions. We reserve the rights to remove anyone who may potential cause great discomfort and danger to others or in unstable mental conditions solemnly by our own judgement, to ensure success of the journey.

COVID-19 Health and Safety Protocols: The well-being of Our guests and staff members on tour will continue to be Our highest priorities. To maintain a healthy environment for travel, We will be establishing and adhering to a detailed set of health and safety protocols for all facets of Your tour. We are committed to following the guidelines of the State Department, CDC, WHO, and authorities of respective countries regarding travel to a particular destination. Detailed protocols for this tour, based on conditions at the time, will be provided
